Terms of Service

The agreement between you and CubieFlow — what each side commits to, and how it ends.

In plain terms

You pay for a subscription; we provide the service and keep your data safe. Either side can end it with notice, and your data leaves with you.

This summary is here to be read. The sections below are what actually applies.

The agreement

By creating a workspace you accept these terms. If you are accepting on behalf of a company, you confirm you have the authority to bind it.

These terms, the Privacy Policy and the Data Processing Agreement together form the whole agreement. Where they conflict, the DPA governs personal data and these terms govern everything else.

Your account

You are responsible for what happens under your credentials, so keep them secure and enable two-factor authentication. Tell us promptly if you believe an account has been compromised.

You must be at least 18 and legally able to enter a contract. You may not use CubieFlow if you are barred from doing so under applicable sanctions or export law.

Acceptable use

The short version: do not use CubieFlow to do something you would not want explained in public.

  • Do not use it for anything illegal in your jurisdiction or ours.
  • Do not send messages to people who have not consented, where consent is required.
  • Do not attempt to access another workspace's data, or probe our infrastructure without written permission.
  • Do not resell access without a partner agreement.
  • Do not deliberately overload the API. Rate limits exist; ask for a raise rather than routing around them.

Fees and billing

Subscriptions are billed monthly or annually in advance. Usage above your plan's limits is billed in arrears at the rates published on the pricing page.

Prices can change with 30 days' notice, and a change never applies mid-term on an annual plan. If a payment fails, we retry over 14 days and email you each time before suspending anything.

Your data

You own your data. We claim no rights over it beyond what is needed to run the service for you.

You can export it at any time, in a documented format, without asking us. If you cancel, you keep export access for 30 days. We will not hold your data to negotiate a renewal.

Availability

We target 99.9% monthly uptime, excluding scheduled maintenance announced at least 48 hours ahead. Enterprise agreements can include a contractual SLA with service credits; the standard plans do not, and we would rather say so than imply otherwise.

Integrations depend on third-party APIs we do not control. When Amazon or Stripe has an outage, CubieFlow will queue and retry, but it cannot make their systems respond.

Liability

To the extent the law allows, our total liability in any twelve-month period is limited to what you paid us in that period. Neither side is liable for indirect or consequential loss.

Nothing here limits liability for death, personal injury, fraud, or anything else that cannot be limited by law.

Ending the agreement

You can cancel at any time from billing settings, effective at the end of your current term. We do not require a phone call.

We can suspend or terminate for material breach, but only after telling you what the breach is and giving you 14 days to fix it — unless the breach is one that makes immediate suspension necessary, such as active abuse of the platform.

Governing law

These terms are governed by the laws of the jurisdiction in which CubieTec is incorporated, and disputes go to its courts. This does not remove any statutory rights you have as a consumer where you live.
